Terms of Service
1. ACCEPTANCE OF TERMS
By creating an account, installing, or using this application, you agree to be bound by these Terms and Conditions. If you do not agree, you must discontinue use of the application.
2. LICENSE TO USE
We grant you a personal, non-exclusive, non-transferable, limited license to use the application for private, non-commercial purposes. This license does not grant ownership and does not permit you to:
• Modify, copy, or redistribute the materials
• Use the materials for commercial purposes or public display
• Reverse engineer, decompile, or attempt to extract the source code
• Remove or alter any proprietary notices
3. FREE ACCESS AND SUBSCRIPTION
Kivvs offers the following access tiers:
Free Access: Upon account creation, all users may access the full course catalog free of charge for an initial period of 30 days. During this period, accessing a lesson requires watching a short advertisement before each session.
Premium Subscription: Users may subscribe to Kivvs Premium on a monthly basis. Additional subscription intervals may be introduced in the future. A Premium subscription provides:
• Unrestricted access to all courses and lessons with no time-based paywall
• An ad-free experience throughout the application
After the initial 30-day free period, non-subscribed users will encounter a paywall before accessing lessons. Learning progress is retained regardless of subscription status. If a user subscribes after the free period, or resumes a lapsed subscription, they may continue from where they left off.
4. BILLING, RENEWALS, AND CANCELLATION
All subscription billing, renewals, and payment processing are handled exclusively by Apple (App Store) or Google (Google Play), depending on the platform through which you downloaded the application. By subscribing, you agree to the billing terms of the respective platform.
Subscriptions renew automatically at the end of each billing cycle unless cancelled in accordance with Apple or Google platform policies. We do not process payments directly and do not have access to your payment information.
To cancel your subscription, use the subscription management tools provided by Apple or Google on your device.
5. REFUND POLICY
All purchases made through the application are processed by Apple or Google. Refund requests are subject to the refund policies of those platforms. We do not independently issue refunds. If you believe you are entitled to a refund, please contact Apple or Google support directly.
6. ADVERTISEMENTS
Non-subscribed users may be shown advertisements during their use of the application. Advertisements are served through Google AdMob. The application may display personalized advertisements based on your device and usage data, or non-personalized advertisements. The type of advertising served may change over time.
By accepting these Terms and Conditions, you acknowledge and consent to the display of advertisements as described above. If you do not wish to see advertisements, you may subscribe to Kivvs Premium.
We do not control the content of advertisements served by Google AdMob and cannot guarantee that all advertisements will be appropriate for all users.
7. DISCLAIMER
The application and all included materials are provided "as is" and "as available." We do not make any warranties—express or implied—regarding accuracy, reliability, or fitness for a particular purpose. Use of the app is at your own discretion and risk. As an early-stage product under active development, the application may experience service interruptions or, in exceptional circumstances, data loss.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages arising from your use of, or inability to use, the application. This includes, but is not limited to, loss of data, loss of progress, loss of profits, or interruptions in service. Service interruptions, data loss, or content unavailability do not entitle users to refunds or compensation beyond what is available under Apple's or Google's platform refund policies.
9. ACCURACY OF CONTENT
While we strive to provide high-quality learning material, the content may contain technical, typographical, or linguistic errors. We make no guarantee that any material is complete, current, or fully accurate.
10. THIRD-PARTY SERVICES
The application integrates with third-party services including Apple App Store and Google Play for billing, RevenueCat for subscription management, Google AdMob for advertisement delivery, and Supabase for backend infrastructure. The application may also contain links to external websites or resources. We do not endorse and are not responsible for the content, privacy practices, or availability of any third-party service or site. Each third-party service is governed by its own terms and privacy policy.
11. CHANGES TO TERMS
We may update or modify these Terms and Conditions at any time. Continued use of the application after changes are published constitutes acceptance of the revised terms.
12. GOVERNING LAW
These Terms and Conditions are governed by and interpreted in accordance with the laws of the Argentine Republic. You agree that any disputes arising from these terms shall be subject to the jurisdiction of competent courts in Argentina. Nothing in these terms limits any rights you may have under the laws of your country of residence that cannot be waived by contract.
